1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HomeScout ("HomeScout," "we," "us," or "our"), operated from Dublin, Ireland.

By creating an account, accessing, or using HomeScout (available at homescout.io and any associated applications), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

You must be at least 18 years of age to use this Service. By using HomeScout, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Description of Service

HomeScout is a software-as-a-service ("SaaS") platform that provides AI-powered tools for searching rental properties in Dublin, Ireland. The Service includes, but is not limited to:

  • Natural language property search and filtering
  • Property saving, comparison, and alerts
  • AI-assisted email drafting to letting agents
  • Viewing scheduling and calendar management
  • AI-assisted lease and contract review
  • Renter profile creation
  • Map-based property overview and commute calculation
  • HomeIndex property scoring

HomeScout is a search and productivity tool. We do not own, manage, let, or sell any properties. We do not act as a letting agent, estate agent, landlord, or property manager. All property listings are aggregated from third-party sources and are displayed for informational purposes only.

3. User Accounts

To access the Service, you must create an account by providing accurate and complete registration information. You agree to:

  • Provide truthful, accurate, and current information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials confidential and secure
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized access to or use of your account

We reserve the right to suspend or terminate any account that we reasonably believe violates these Terms, contains false information, or is being used fraudulently. One individual may maintain only one account.

4. Subscription Plans and Fees

4.1 Plans

HomeScout offers subscription plans at varying tiers (currently: Explorer, Scout, and Ranger), each with different features, usage limits, and pricing. Plan details, including current pricing and feature availability, are displayed on our pricing page and may be updated from time to time. We also offer Team/Enterprise plans for organizations.

4.2 Billing

Paid subscriptions are billed in advance. Monthly subscriptions are billed on a recurring monthly cycle. Three-month (quarterly) subscriptions are billed as a single upfront payment covering the full three-month period. All prices are in euros (EUR) and inclusive of applicable taxes unless otherwise stated. Payments are processed securely through our third-party payment provider (Mollie).

4.3 Cancellation

Monthly subscriptions: You may cancel your monthly subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. You will not be charged for subsequent periods after cancellation.

Three-month (quarterly) subscriptions: Quarterly subscriptions are committed for the full three-month term. You may cancel to prevent automatic renewal, but the cancellation will only take effect at the end of the three-month period. Early termination of a quarterly subscription does not entitle you to a partial refund.

4.4 Refund Policy

All subscription fees are non-refundable. This applies to both monthly and quarterly subscription plans. Specifically:

  • Monthly plans: No refunds are provided for the current billing period after payment has been processed. You may cancel at any time to prevent future charges.
  • Quarterly (3-month) plans: No refunds, whether full or partial, are provided once the quarterly payment has been processed. By purchasing a quarterly plan, you acknowledge and accept that the full amount is non-refundable regardless of whether you use the Service for the full period.

Exceptions to this policy may be made at the sole discretion of HomeScout in cases of documented billing errors or where required by applicable law. To request an exception, contact us at support@homescout.io.

4.5 Price Changes

We reserve the right to change subscription pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following at least 30 days' written notice (via email or in-app notification). If you do not agree with the new pricing, you may cancel your subscription before the new price takes effect.

4.6 Free Tier

The Explorer (free) tier provides limited access to the Service at no charge. We reserve the right to modify, limit, or discontinue the free tier at any time without prior notice.

5. AI-Generated Content and Disclaimers

5.1 General AI Disclaimer

HomeScout uses artificial intelligence and machine learning technologies to power various features of the Service. AI-generated content, including but not limited to search results, email drafts, property scores, and contract analysis, is provided for informational and convenience purposes only. AI output may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing, verifying, and deciding whether to act upon any AI-generated content.

5.2 AI Contract Review — Not Legal Advice

The AI contract review feature is provided strictly as an informational tool and does NOT constitute legal advice, legal representation, or a solicitor-client relationship. The AI-generated analysis of lease agreements, tenancy contracts, or any other legal documents is automated commentary that may be incomplete, inaccurate, or inapplicable to your specific circumstances.

HomeScout is not a law firm, solicitor, or legal services provider. No output from the AI contract review feature should be relied upon as a substitute for professional legal advice. You should always consult a qualified solicitor or legal professional before signing any lease, tenancy agreement, or other legally binding document. HomeScout expressly disclaims all liability arising from reliance on AI contract review output.

5.3 AI Email Drafting

AI-drafted emails are suggestions only. All emails are sent by you, from your account, after your explicit review and confirmation. HomeScout does not send emails on your behalf without your approval. You are solely responsible for the content and consequences of any emails you choose to send.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You shall not:

  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Scrape, crawl, or use automated means to extract data from the Service without our prior written consent
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems and networks
  • Interfere with, disrupt, or overburden the Service or its infrastructure
  • Circumvent, disable, or tamper with any security, access control, or usage-limit features of the Service
  • Reproduce, redistribute, sublicense, or resell access to the Service
  • Use the Service to harass, spam, or send unsolicited communications to property agents or other parties
  • Upload or transmit viruses, malware, or other harmful code
  • Misrepresent your identity or impersonate any person or entity
  • Create multiple accounts to circumvent usage limits or bans

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account, reporting conduct to law enforcement, and pursuing legal remedies.

7. Intellectual Property

The Service, including all software, designs, text, graphics, logos, icons, and other content (excluding third-party property listings and user-submitted content), is owned by HomeScout and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of content you submit to the Service (e.g., renter profile information, saved preferences). By submitting content, you grant HomeScout a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the Service.

8. Property Listings and Third-Party Content

Property listings displayed on HomeScout are sourced from third-party providers. We do not verify, endorse, or guarantee the accuracy, completeness, legality, or availability of any listing. Listings may be outdated, incorrect, or no longer available. HomeScout is not a party to any transaction between you and a property owner, landlord, or letting agent.

You acknowledge that HomeScout bears no responsibility for:

  • The accuracy, quality, or legality of property listings
  • The conduct of landlords, letting agents, or other third parties
  • The outcome of any rental applications, viewings, or tenancy agreements
  • Any loss or damage arising from your interaction with third parties discovered through the Service

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein. We comply with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • HomeScout does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • In no event shall HomeScout, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service.
  • HomeScout's total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to HomeScout in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless HomeScout, its directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit to the Service; or (e) your interaction with property agents, landlords, or other third parties through the Service.

12. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service (including features, usage limits, or functionality) at any time, with or without notice. We will make reasonable efforts to provide advance notice for material changes that affect paid subscribers. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Account Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or extended inactivity.

Upon termination: (a) your right to use the Service ceases immediately; (b) we may delete your account data after a reasonable retention period, subject to our Privacy Policy and applicable law; (c) any outstanding fees remain due and payable; and (d) provisions of these Terms that by their nature should survive termination shall continue in effect (including Sections 4.4, 5, 7, 10, 11, and 15).

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice within the Service at least 14 days before the changes take effect. The "Last updated" date at the top of this page indicates the most recent revision.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Nothing in these Terms affects your statutory rights as a consumer under applicable EU law.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeScout regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
